The Whitby Dracula Treasure Hunt organised by Chimp Management Ltd will be taking place on 14th October 2023 (the ‘event’). Participants must register for the event by completing a registration form. The form must include all members of the booking (Participants)
If you are booking the event for more than one Participant, it is the responsibility of the person making the booking to ensure that all Participants taking part are aware and have agreed to the Terms and Conditions below.
Terms and Conditions
These Terms and Conditions, as detailed below apply to all Participants taking part in the event.
Completion of this registration form by (or on behalf of) the Participant/s is acceptance of these Terms and Conditions for all of those included within the booking.
1 The Participant/s acknowledges that:
a. the event will take place in the Yorkshire seaside town of Whitby; notorious for its inclined roads/paths, uneven surfaces, cobblestone streets, old pavements, and steps throughout the town. Including but not limited to the 199 steps leading to Whitby Abbey. Participants must be physically capable to traverse steep and uneven terrain for most of the day
b. Chimp Management Ltd does not accept responsibility if a participant is unable to complete part or all of the session due to physical limitations.

c. the event is an independent, fun and challenging Whitby Dracula Treasure Hunt, primarily intended to raise funds for charities chosen by the organiser;
d. they are entering the event as an independent participant; no contractual relationship exists between the Participant and any charity chosen by the organiser;
e. they are responsible for their actions whilst taking part in the event and the organiser does not accept responsibility for the actions of the Participant, nor the consequences of such actions;
f. they accept and acknowledge that the organiser has no responsibility or liability for any loss or damage to the Participant’s belongings;
g. the organiser excludes all and any liability for loss or damage to the participant to the extent that it can be legally excluded;
h. they are physically and mentally capable of taking part in the event and have the ability to complete the event as detailed. The route will not deviate from public rights of way. It is the responsibility of the participant to ensure that they do not access any private property or land during the event.
i. the organiser will provide the Participant with a basic map of the treasure hunt area, a selection of clues and access to a support organiser’s mobile phone. Should a participant need assistance at any time they are to contact the organisers via a call or text.
j. this event is for those 18 years of age and older. Evidence of age may be requested by the organiser;
k. they accept full responsibility for any fees or costs incurred or arising from the need for repatriation;
l. they are responsible for supplying their own refreshments, clothing, and any other equipment required by them;
m. they must wear appropriate clothing and footwear taking into consideration the terrain and weather conditions on the day. The organiser suggests closed shoes such as walking boots or trainers. Open shoes, sandals, flip-flops or shoes with high heels are not recommended. Participants who do not follow the organiser’s recommendations in terms of clothing and footwear, do so at their own risk.
2 Due to the active and variable nature of this event, the Participant’s own judgement is paramount and liability for Participants’ decisions are their own, in priority above that of the organisers’ suggestions.
3 PARTICIPANTS HAVE THE FULL AND OVERRIDING DECISION TO TAKE PART IN THE MANNER THEY FEEL IS SAFE AND WITHIN THE PARTICIPANT’S OWN CAPABILITIES.
4 By completing this registration form, the Participant consents to the organiser contacting the Participant with pre‐event information and about relevant products or services and research via email, post, phone, SMS. The Participant can opt out at any time via replying to the emails the Participant is sent or by contacting the organiser by email or telephone.
5 In any circumstance where the Participant fails to complete the event for any reason, the Participant agrees to telephone/contact the organiser before the close of the event and report to the organiser. Not doing so will mean that a search may be organised, and the Participant will be liable for any costs incurred.
6 The Participant accepts that event entry fees cannot be refunded or transferred under any circumstances.
7 The Participant accepts and acknowledges that the organiser reserves the right to cancel any event, due to extreme weather conditions or Force Majeure. In such a situation, each Participant’s entry with be automatically moved to any rescheduled event or refunded.
8 The Participant is expected not to drop or leave any litter on any part of the route and to dispose of it responsibly at an appropriate place or bin. Any Participant found littering will be disqualified from the event.
9 The Participant is expected to respect the town of Whitby It should be remembered that this is both a working landscape and home to many communities.
10 The Participant accepts that by participating in the event, this does not confer any right (by implication or otherwise) on the Participant to use, alter, copy or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property of the organiser and/or their chosen charities.
11 If any term of this Agreement is to any extent held invalid, illegal, or incapable of being enforced, such term shall be excluded to the extent of such invalidity, illegality, or unenforceability; all other terms hereof shall remain in full force and effect.
12 The Participant accepts that a person who is not party to this contract shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of it.
