Chimp Management Retreats – Booking Terms & Conditions
All retreat participants must make themselves aware and accept the terms & conditions associated with the Retreat, each guest must be responsible for taking out appropriate personal holiday, cancellation & Covid cover insurance policy for the full duration of their chosen Retreat.
Chimp Management accepts bookings subject to the following conditions as laid out below.
INTERPRETATION & DEFINITION:
In the agreement unless otherwise specified the following expressions refer to the following meanings.
Booking – The booking made by the Client with Chimp Management & as set out in the confirmation email.
Confirmation Email – The confirmation email produced by Chimp Management upon making a booking.
Contract – The contract between the Client & Chimp Management under which the services are provided by Chimp Management to the Client.
Client – The person, business or company who makes the booking with Chimp Management. All individuals to whom the services are provided by Chimp Management must be of a minimum age of 18 years.
Payment – The total fee due at the time of booking the retreat.
Fee – The amount payable to Chimp Management under the contract.
Force Majeure / Special Circumstances – Any act, event, omission or accident beyond Chimp Management’s reasonable control including but in no way limited to Act of God, war, riot, civil commotion, malicious damage, compliance with any law or government order, rule, pandemic, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm, adverse weather, default of suppliers or subcontractors, strikes, lock-out’s, or other industrial disputes, failure of a utility service or transport network.
Major Change – A change in the date or the content of the service. The exception being under “special circumstances”.
Chimp Management –The provider of the Retreat
Wording importing the singular meaning shall include the plural meaning & vice versa.
The headings in these conditions are for convenience only & shall not affect their interpretation.
ACCEPTANCE:
A contract for the services is made between Chimp Management & the Client upon the issue of a formal Receipt of Confirmation of booking by Chimp Management. The Confirmation Receipt will be issued once full payment has been received.
The contract is subject to the booking conditions outlined herewith which the Client has been deemed to have read & fully understood at the time of booking. These booking conditions can only be varied by written agreement between Chimp Management & the Client.
SERVICES:
The activities & services provided by Chimp Management to the Client under the terms of the contract & service shall be construed accordingly.
BOOKING:
To place a Retreat booking with Chimp Management, Chimp Management requires full payment of the sum highlighted on the website together with the Client’s full name and contact details. If a booking is made by telephone or e-mail the client shall be deemed to have read & fully understood these conditions prior to making payment. Once payment has been received a formal Email Confirmation will be sent to the Client detailing their formal reservation confirmation, the retreat date & programme chosen.
Chimp Management reserves the right to decline any booking at their discretion.
FEE & PAYMENT TERMS:
The fee payable at the time of booking shall include the planning, organising & delivery of the proposed services.
Upon successful payment of the Retreat fee by the client a contract is formed for the agreed programme to be delivered.
RESPONSIBILITIES OF THE CLIENT:
The fee does not include any travel to & from the Retreat location at which the proposed services shall be provided & this shall be the Client’s sole responsibility.
It is the Client’s responsibility to inform Chimp Management in writing of any past, present or potential health issues that may make them unsuitable to participate in the services agreed, failure to disclose any such information may result in Chimp Management terminating the contract & withdrawing the Client from the services without refund, notwithstanding conditions of cancellation by Chimp Management.
MEDICAL & HEALTH:
If you have any medical condition/s that may make you unsuitable to participate & or may impact your or others’ participation in the Retreat services, you are required to notify us of them in full prior to making your booking.
If Chimp Management or any member of the Chimp Management team believe that your health or safety is at risk, or if you have failed to disclose to Chimp Management in writing any illness, injury or any previous or current medical or health condition / reason that could potentially impact on your ability to participate in the Retreat services. This could result in Chimp Management’s refusal to allow you to participate in all / part of the services. In such a situation, your contract may be terminated by Chimp Management at the sole discretion of Chimp Management a refund or partial may not be offered at this time.
SPECIAL REQUESTS, MOBILITY & DIETARY REQUIREMENTS :
If there is food included with your booking this will be provided by a third-party caterer. To ensure that the Clients dietary requirements are catered for please ensure that you provide details of any allergies within your Booking Preferences Form. This will be sent to you after you have made a confirmed booking.
The Booking Preferences Form will also ask you to share any mobility or special requests with Chimp Management. Chimp Management will endeavour to accommodate mobility and special requests but cannot guarantee all requests will be actioned.
VARIATIONS & AMENDMENTS:
Chimp Management reserves the right to change any price or other particulars of the services before the contract becomes binding.
If there is a major change Chimp Management shall notify the Client forthwith, Chimp Management shall seek to offer the Client arrangements as close to the original as it is reasonably possible in the circumstances. If there is any other change other than a major change Chimp Management is not obliged to inform the client in advance or obliged to pay any compensation.
CANCELLATION BY THE CLIENT:
If the Client wishes to cancel the reservation, they must advise Chimp Management in writing / via confirmed email to retreats@chimpmanagement.com soon as reasonably possible. Any cancellation of the contract will be subject to the following cancellation charges. For the avoidance of doubt the cancellation charges are based on the number of days before the arrival date of the services.
Date of cancellation – Cancellation charge
Less than 3 weeks – 100% of the cost of the retreat will be retained by Chimp Management
Less than 6 weeks – 75% of the cost of the retreat will be retained by Chimp Management
Less than 9 weeks – 50% of the cost of the retreat will be retained by Chimp Management
More than 12 weeks – 30% of the cost of the retreat will be retained by Chimp Management
GUEST REQUEST TO MOVE / CHANGE A RETREAT RESERVATION TO A NEW DATE:
Should the Client request to move their Retreat date to a new / alternative date, then the payment previously received by Chimp Management will be deemed non-refundable. If Chimp Management accept a request by the client to move their reservation (this is at the discretion of Chimp Management) to a new/alternative date an administration fee of £30.00 per booking may be applied
CANCELLATION BY CHIMP MANAGEMENT:
Chimp Management will always endeavour to fulfil confirmed bookings; however, Chimp Management do reserve the right to cancel a scheduled Retreat date or an individual booking. If Chimp Management cancels a booking prior to the commencement of the services the client will be offered an alternative date, or where applicable a full refund of all monies paid by the guest for the specified reservation. *The exception is that: if the cancellation is due to “special circumstances” which are beyond the control of Chimp Management.
SERVICES:
Any information on / about our services published by Chimp Management for it’s literature & website is designed for illustrative purposes only.
If the client elects not to participate in any of the services being provided, Chimp Management has no obligation to provide an alternative service & the Client will not be entitled to a refund.
The Client must refrain from any illegal act or any conduct physical or verbal which may give offence or cause danger or damage to any person or property. If Chimp Management or any of its team become aware of any such action then Chimp Management or any of its team may at their absolute discretion have the Client immediately removed from the retreat without refund or compensation. Chimp Management will have no liability whatsoever to the client under such circumstances.
IF THERE IS A PROBLEM DURING YOUR STAY:
If there is a problem during the Retreat, the Client must report it in the first instance to the Retreat Mentor or a Chimp Management team member, if it is still unresolved then the issue should be reported immediately to Chimp Management’s Client Services Director – retreats@chimpmanagement.com so that all efforts may be made to resolve the problem promptly & effectively. In the unlikely event that the problem cannot be resolved & the Client wishes to make a complaint then the Client must notify Chimp Management in writing within 14 days of the end of the retreat. Failure to provide notice of the complaint in accordance with the above will preclude the Client from being entitled to take any further action against Chimp Management.
VENUE – BENNETSTON COACH HOUSE
Accommodation
Chimp Management’s Bennetston Coach House offers eight private ensuite bedrooms comprising of 3 double rooms and 5 single rooms. Once a room type is booked by the Client Chimp Management will randomly allocate a room within the type booked.
Please note that there are no housekeeping services provided during the duration of the Retreat.
For your comfort the Coach House offers a shared lounge/discussion room and kitchen it is the responsibility of the guests to keep these areas clean and tidy for other residents to enjoy.
The Coach House has a check-out policy which requires guests to vacate their rooms on the agreed day of departure by no later than 12.00 noon. Check-in for the Retreat is between 15:00 and 18:00 on the specified arrival day.
The retreat is not staffed 24 hours a day, should you need assistance during your stay please refer questions to your Mentor or call the assistance number provided. This will connect you with a Chimp Management Staff member.
The retreat is a keyless venue, you will be issued a main door key code and your room key code prior to your stay. The Client agrees that codes will not be shared with any other person. Should you have difficulty accessing the Coach House please call the contact number provided.
The Coach House is equipped with internal and external CCTV cameras. The internal cameras are situated in public areas only. For your privacy the CCTV system does not record sound and recordings are deleted every 30 days. By booking a retreat you are confirming that you acknowledge that the recordings will be made. Chimp Management will not use the footage for anything other than for the security of guests, staff, and the property.
Damage or breakages, we understand that accidents do happen. If the property or items within the Coach House is broken or damaged the Client agrees to immediately inform the Mentor or contact a Chimp Management team member to inform of the incident. The Client acknowledges that Chimp Management reserve the right to charge for a replacement or repair to the property or item.
LIABILITY:
None of the exclusions & limitations in these conditions are intended to limit any rights the Client may have under statute or common law which may not be excluded, nor in any way to exclude or limit liability to the Client for personal injury or death resulting from Chimp Management’s negligence or that of its employees or agents, or for any liability incurred as a result of fraud or fraudulent misrepresentation by Chimp Management.
Neither Chimp Management nor any of its Directors, employees or agents will be liable for any loss or damage to any personal property or vehicle belonging to the client during the services.
All guests must refrain from any illegal act or any conduct unbecoming a Retreat guest, conduct or language which may give offence to a staff member or guest or any act which may cause damage to property. If Chimp Management or any of its staff, become aware of any such act / conduct then Chimp Management may, at their absolute discretion, ask the client to leave the premises, this will be without refund or compensation to the guest, in these circumstances Chimp Management will have no further responsibility or liability to the guest.
LAW & JURISDICTION:
These terms & conditions shall be governed & construed in accordance with UK law.
